Terms of Service

1. Acceptance of Terms

By accessing or using the WayLucid platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service, including both consumers and business account holders.

2. Description of Service

WayLucid provides a location-based engagement and loyalty platform that connects consumers with local businesses through verified foot traffic, gamified experiences, and rewards. The Service includes consumer-facing features (treasure hunts, check-ins, rewards wallet, leaderboards) and business-facing features (campaign management, analytics, customer intelligence, subscription plans).

3. User Accounts

You must create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify WayLucid immediately of any unauthorized use of your account. WayLucid reserves the right to suspend or terminate accounts that violate these Terms.

4. Business Accounts

Business account holders agree to provide accurate and complete business information. Subscription plans are billed monthly or annually as selected. Cancellation takes effect at the end of the current billing period. Business accounts are subject to tier-based feature limits as described in the pricing documentation. WayLucid reserves the right to modify pricing with 30 days' advance notice.

5. Location Data & Verification

The Service uses GPS location data and QR code scanning to verify user visits to business locations. By using check-in features, you consent to the collection and processing of your location data for verification purposes. Location data is used solely for visit verification and aggregated analytics. You may disable location services at any time, though this will limit certain features.

6. Rewards & Campaigns

Rewards earned through the Service are subject to the terms set by the issuing business. WayLucid is not responsible for the fulfillment of rewards by third-party businesses. Rewards may have expiration dates and usage restrictions as specified by the issuing business. WayLucid reserves the right to void rewards obtained through fraudulent activity.

7. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to circumvent verification mechanisms including GPS spoofing or QR code manipulation; (c) create multiple accounts to exploit rewards; (d) interfere with or disrupt the Service or servers; (e) scrape, data mine, or extract data from the Service without authorization; (f) impersonate another person or entity.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by WayLucid and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Business account holders retain ownership of their business content (logos, descriptions, campaign content) uploaded to the Service.

9. Data Ownership

Business account holders own the customer engagement data generated through their campaigns and locations. WayLucid may use anonymized, aggregated data for platform improvement and analytics. Individual user data is governed by our Privacy Policy. Business accounts may export their data at any time through the LucidCore analytics dashboard.

10. Refund & Cancellation Policy

Monthly Subscriptions: Monthly subscriptions may be cancelled at any time through your LucidCore dashboard or by contacting our support team. Cancellation takes effect at the end of the current billing period, and you will retain full access to paid features until then. No partial refunds are issued for unused portions of a billing period.

Annual Subscriptions: Annual subscriptions may be refunded in full within 14 days of purchase, provided no campaigns or hunts have been created under the account. After 14 days or upon campaign/hunt creation, annual plans follow the same cancellation policy as monthly plans — cancellation takes effect at the end of the annual billing period with no partial refund.

Free Tier: The Free tier requires no payment and may be used indefinitely. Downgrading from a paid tier to Free takes effect at the end of the current billing period.

Early Adopter & Promotional Discounts: Promotional pricing (including early adopter discounts) applies for the specified promotional period only. After the promotional period ends, standard pricing applies. Cancellation during a promotional period follows the same refund rules above.

How to Request: To request a cancellation or refund, contact [email protected] with your account email and business name. Refund requests are processed within 5–10 business days.

11. Limitation of Liability

WayLucid shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid to WayLucid in the twelve months preceding the claim. This limitation applies to all causes of action in the aggregate.

12. Modifications

WayLucid reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Maricopa County, Arizona.
